Jaffa cakes are free of VAT because they're classed as cakes, not biscuits. VAT on food items is added only when the food is seen as a luxury, i.e. crisps, sweets, fizzy drinks. Obviously cakes are essential and full of the nutrients we need , but the debate in court went something like this.....Definition of a biscuit "hard when fresh, soft when stale"....Definition of a cake "soft when fresh, hard when stale".
